Trademark Registration in Nepal is governed by the Patent, Design and Trademark Act, 1956 (2022), under the supervision of the Department of Industry (DOI), Ministry of Industry, Commerce and Supplies.
Step-by-Step Process of Trademark Registration
- Submission of Application for Registration before DOI
- Preliminary Examination by DOI
- Publication of Trademark in Industrial Property Bulletin
- Registration of Trademark if the opposition isn’t received by a third party within 90 days of Publication in the IP Bulletin
Documents Required for Registration of Trademark
- Application of Trademark Registration
- Label of Trademark (4 copies)
- BoD meeting Minute (Name of the person taking PoA can be written in the minute itself)
- Citizenship certificate of the person taking PoA
- The stamp of the company is compulsory in the meeting Minute
- Certificate of Company Registration
- Letter of completion of annual compliance
- PAN/VAT (tax) registration Certificate
- Tax Clearance Certificate
Grounds of Refusal of Trademark Registration:
- If such a trademark damages the reputation of any person or institution
- If such a trademark contradicts public conduct/morale or national interest
- In case such trademark damages the goodwill of the trademark of any person
- In case such trademark is found to have already been registered in the name of another person
Government Fee for Trademark Registration:
Application Fee: NPR 1,000/-
Registration Fee: NPR 5,000/-
